End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("you" or "User") and 1800GEEK ("we," "us," or "our"). By downloading, installing, accessing, or using any software, application, remote-support tool, or utility made available by 1800GEEK (collectively, the "Software"), you agree to be bound by this EULA. If you do not agree, do not install or use the Software.

1. License Grant

Subject to your compliance with this EULA, 1800GEEK grants you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for the purpose of receiving technology support services from 1800GEEK on devices you own or are authorized to manage.

2. Remote-Support Tools

Some support is delivered using remote-access tools. You acknowledge that such tools allow a technician to view and, with your permission, control your device during a support session. Remote sessions begin only with your authorization, you may observe the session, and you may end it at any time. You are responsible for closing the tool and revoking access when your session is complete.

3. Restrictions

• You may not copy, modify, reverse-engineer, decompile, or disassemble the Software, except to the extent permitted by law.
• You may not rent, lease, sell, sublicense, or distribute the Software.
• You may not use the Software for any unlawful purpose or in violation of any third-party rights.
• You may not use the Software to access devices or data you are not authorized to access.

4. Third-Party Software

The Software may rely on, or help you install, third-party software that is subject to its own license terms. 1800GEEK does not own such third-party software and is not responsible for it. You are responsible for complying with, and maintaining valid licenses for, any third-party software used on your device.

5. Ownership

The Software is licensed, not sold. 1800GEEK and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted except as expressly stated in this EULA.

6. Data & Privacy

Your use of the Software is also subject to our Privacy Policy. We recommend backing up important data before any support session. 1800GEEK is not responsible for loss of data.

7. Disclaimer of Warranties

The Software is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, 1800GEEK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from or related to your use of the Software. Our total liability shall not exceed the amount you paid for the related support service.

9. Termination

This license is effective until terminated. It terminates automatically if you breach any term of this EULA. Upon termination, you must stop using and remove the Software. Sections relating to ownership, disclaimers, and limitation of liability survive termination.

10. Governing Law

This EULA is governed by the laws of the State of Kansas, USA, without regard to its conflict-of-laws principles, except where local consumer-protection laws provide otherwise.

11. Changes to This EULA

We may update this EULA from time to time. The current version will always be posted on this page with an updated date. Continued use of the Software after changes are posted constitutes acceptance of the updated EULA.
